Specifically, the research aims to identify key operational risk management indicators tailored for homestays, focusing on homestay users in Nglanggeran Tourism Village, Gunungkidul, Yogyakarta, Indonesia. A total of 156 respondents, all with prior experience in the area, participated in the study, which employed multi-stage sampling and triangulated data collection methods. The research utilized an explanatory design, with data analyzed through Structural Equation Modeling (SEM). To complement the quantitative findings, in-depth interviews were conducted with homestay managers and participants. The study investigated three primary variables: operational risk management, user satisfaction, and user loyalty. The results show that effective operational risk management has a positive and significant impact on user satisfaction. Furthermore, user satisfaction is a key driver of user loyalty, as satisfied users are more likely to revisit and recommend the homestay to others. This study provides valuable insights into the role of operational risk management in enhancing user experience and fostering long-term customer loyalty in the homestay sector.
2025-02-21T00:00:00+00:00Copyright (c) 2025 Amin Kiswantoro, Sugiarto Sugiarto, Tonny Hendratono, Nur Rohman, Rizky Maulanahttps://ajosh.org/index.php/jsh/article/view/497Legal Certainty In The Implementation of Judicial Review Decisions By The Constitutional Court In Indonesia 2025-02-05T02:26:54+00:00Bun Joi Phiaucallmebjp@gmail.comAmzulian Rifaiamzulianrifai@yahoo.comAbdul Latifprof.abdul.latif59@gmail.com
This study aims to analyze the implementation of Constitutional Court decisions in Indonesia, particularly focusing on the gap between the legal force of such decisions and their actual enforcement. Despite the Constitutional Court's decisions being final and binding, many are not implemented in accordance with the principle of erga omnes, leading to legal uncertainty and hindering the achievement of justice. This research employs a normative juridical approach, utilizing the theory of the state of law, the constitution, and legal certainty as analytical tools. The study's findings indicate that while Constitutional Court decisions have permanent legal force and should be binding on all parties, inconsistent implementation by institutions such as the House of Representatives and the President remains a significant issue. The primary cause of non-compliance is often the lack of adequate legislative responses or the absence of clear implementing regulations. Furthermore, the study highlights that an ideal implementation of Constitutional Court decisions would require stronger monitoring mechanisms and sanctions to ensure compliance. In conclusion, this study recommends revising relevant laws and regulations and establishing more detailed implementation procedures to support the effective execution of Constitutional Court decisions, ensuring legal certainty, justice, and public trust in the legal system.
2025-02-22T00:00:00+00:00Copyright (c) 2025 Bun Joi Phiau, Amzulian Rifai, Abdul Latifhttps://ajosh.org/index.php/jsh/article/view/505The Role of Micro, Small, and Medium Enterprises (MSMEs) in Central Kalimantan in Community Economic Welfare2025-02-05T02:22:35+00:00Dedi Takaridedi.takari@feb.ur.ac.idDicky P. In fact, the Governor of DKI Jakarta passed a special regulation for this program, which is contained in Governor Regulation Number 32 of 2019 concerning Revitalisation of Vocational High Schools. Therefore, this study aims to analyse the implementation of good governance principles in the implementation of the Vocational High School Revitalisation program by the DKI Jakarta Provincial Government. The research method used is a descriptive method with a qualitative approach. The theory of good governance is the analytical framework in this research. The data collection technique was conducted using a literature study of several literatures, such as journal articles, online news, and official government publications. Data were analysed using three stages, namely data reduction, data presentation, and conclusion drawing. The findings of this study show that the DKI Jakarta Provincial Government has well implemented the principles of transparency as well as the principles of effectiveness and efficiency in the implementation of the DKI Jakarta Vocational Revitalisation program. Meanwhile, the principle of participation has been fulfilled quite well. The principles of accountability and fairness cannot be assessed further. This is due to the lack of progressive reports from the DKI Jakarta Provincial Government regarding the implementation of Revitalisation of Vocational Schools. However, based on the available data, the principle of justice has been implemented quite well. In contrast to the principle of accountability, which seems to be less considered by the DKI Jakarta Provincial Government.
2025-02-22T00:00:00+00:00Copyright (c) 2025 Erma Widyastuti, Andreo Wahyudi Atmokohttps://ajosh.org/index.php/jsh/article/view/508Legal Strength of Village Head Certificate As a Basis for Land Ownership Rights2025-02-07T08:29:49+00:00Esau Djahaesaudjaha@gmail.comBasuki Rekso Wiboworeksobasuki@gmail.comDedy Ardian Prasetyodeape.prasetyo@gmail.com
Law Number 5 of 1960 concerning the Basic Agrarian Law (UUPA) in Article 19 mandates the implementation of land registration with the aim of providing legal certainty and protection. The research method used is normative juridical with an analytical approach, with a descriptive analytical specification. Normatively (das-sollen), the provisions regulated in the legislation always state that the purpose of land registration is to achieve legal certainty through the issuance of certificates. Empirically (das-sein), the reality in practice shows that land conflicts are cross-sectoral issues, where each sector has its own rules that overlap with one another. This correlates with differences in perceptions and relations between the parties involved in the agrarian conflict itself. The research findings show that the court's decision in resolving land conflicts with evidence of Village Certificates / Land Certificates is as follows: In practice, it turns out that obtaining a certificate is not as easy as the ideal condition it should be. Constraints such as distance from the administrative center, untidy and overlapping records, difficulties in field verification facilities, and various other obstacles make obtaining a certificate not a simple task. Village Certificates (SKD)/Land Certificates (SKT) are factually easier to obtain because they only require the authority of the village and records available at the village head's office. SKD/SKT is actually a supporting document and not a primary document, but in court, this document can serve as valid evidence of land ownership rights, replacing the primary certificate due to the significant role of the judge.
2025-02-22T00:00:00+00:00Copyright (c) 2025 Esau Djaha, Basuki Rekso Wibowo, Dedy Ardian Prasetyohttps://ajosh.org/index.php/jsh/article/view/502Exploring the Potential for a Hybrid Laundry Service in Jatinangor2025-02-05T02:30:33+00:00Eugenia Efendyeugenia_efendy@sbm-itb.ac.id
This study explores the potential for a hybrid laundry service to address the unique challenges faced by the area’s predominantly student population. Djunaedijunaedipasca@unswagawati.ac.idIsmail Ismailubkismail@gmail.com
This research aims to formulate a maximum threshold for political party coalition membership based on proportionality principles to prevent dominance. Research findings indicate that in Indonesia's positive legal system, particularly regarding presidential elections, there are no legal norms explicitly defining political party coalition dominance in presidential candidate nominations. Article 6A of the 1945 Constitution does not directly address this matter but implicitly regulates the limitation of absolute dominance through a "two candidate pairs" mechanism in the second round, preventing all parties from joining a single coalition. Law Number 7 of 2017 on Elections also provides no explicit definition, though Article 229 Paragraph (2) implies prevention of nomination monopoly by a single coalition. Theoretically, political party coalition dominance can occur macroscopically (power concentration by large coalitions) and microscopically (internal domination by majority parties within coalitions). In the macroscopic context, dominance includes the formation of large coalitions that dominate the presidential nomination process, while in the microscopic context, dominance occurs when one political party within the coalition has excessive influence over joint decisions. To prevent this, a normative formulation of maximum coalition membership thresholds based on proportionality principles is proposed. Two alternative maximum threshold percentages are proposed: 25% or 50% of the total number of political parties participating in the election.
2025-02-22T00:00:00+00:00Copyright (c) 2025 Harimurti Adi Nugroho, O. Tamangil Nuhuten Village, located in South Kei Besar Sub-district, Southeast Maluku Regency, faces great challenges in meeting the clean water needs of its residents. This study was conducted to evaluate the clean water distribution scheme through technical and economic approaches. The methods used included field surveys, water distribution simulation using EPANET 2.2 software, infrastructure development cost analysis, and a comprehensive assessment of construction time requirements. The results of the analysis show that the hilly topography of the village is the main obstacle in water distribution. To overcome this obstacle, a gravity-based distribution system is recommended. Based on EPANET 2.2 simulation, this system is able to fulfill the community's clean water needs efficiently. The total cost of building the distribution network is estimated at Rp8,202,383,000.00 with a construction time of six months. Furthermore, this research provides an in-depth analysis of the required time allocation for each construction phase to ensure project feasibility and efficiency. This research is expected to be a reference for the government and related parties in designing a water distribution system that is effective, sustainable, and in accordance with the needs of the Tamangil Nuhuten Village community.
2025-02-22T00:00:00+00:00Copyright (c) 2025 Paschal Rumihin, Andi Patriadi, Sajiyo Sajiyohttps://ajosh.org/index.php/jsh/article/view/500Ethics and Intellectual Property Rights in Genetic Therapy 2025-02-05T02:37:18+00:00Raymond R.
